Civil Division

The Civil Division is a specialized unit of the Kitsap County Sheriff's Office that serves legal documents throughout Kitsap County, conducts evictions, and enforces orders of the court.


Responsibilities:

Serve civil and other legal processes as prescribed by law.

Enter and serve Protection Orders that are within the jurisdiction of unincorporated Kitsap County. If you are unsure of your jurisdiction, whether it is Kitsap County or a local police jurisdiction, enter the property address into the Law Enforcement Jurisdiction Map.

Serve and enforce court orders as they pertain to executions of real and personal property.

Execute court ordered Writs.

Execute court ordered evictions.

  Service of Documents

The Civil Division accepts legal documents for service; however, we must prioritize service of Orders and Petitions that require the assistance of commissioned law enforcement personnel and Writs. Common document types that we receive for service include Subpoenas, Small Claims, Summons and Petitions, Summons and Complaints, Family Law, etc. We will not accept requests to serve electronic media (disk, thumbdrive, etc.). 

The Civil Division can accept submissions of documents in the following ways:

We will need as much information as possible regarding the person we are serving.

The number of service attempts is determined by how much time we are given to attempt service and our ability to locate the person(s) you wish to have served. Our office typically does not serve in the evenings or on weekends. We require payment of our fees in advance. Documents cannot be served to a post office box or personal mailbox; they must be physical address. We will never guarantee a successful service. Expedited service is not an option currently. If your documents do not have a hearing date set, it is our office policy that we will attempt for a 30-day period. The number of attempts within that period is not guaranteed.

*Please note, if providing family law documents regarding custody for service, we do not transfer custody of minors except under a court order of a Writ of Habeas Corpus. 

 Service Fees

Our service fees are comprised of three separate components: type of documents, mileage, and return of service. Service fees must be paid in advance prior to processing. Under no circumstances can these fees be waived. Fee waivers are not accepted

The mileage fee is determined from our location at 614 Division St, Port Orchard, WA 98366.

To avoid a delay in processing your service packet, please contact the Civil Division for an accurate quote prior to sending your documents via mail. If a check is mailed with the service packet for the wrong amount, the Civil Division will mail back the check, packet, and letter stating the correct amount.

    • Check or money order should be made payable to "Kitsap County Sheriff's Office or KCSO." 
  • Debit/Credit cards
    • Fee for Credit/Debit cards - 2.4% of the total due, with a minimum fee charge of $2.00

IMPORTANT: You must submit your request as an attached PDF FILE. For security reasons, we are unable to access all other file types. This includes attached or embedded image files. Additionally, we are unable to access documents saved in your personal storage drive. Do not send links to files shared from your Google Drive, iCloud drive, etc. We are not responsible for organizing your service request; please provide instructions and organize your PDFs accordingly.

Card payments are processed through a system called Point and Pay. If you have received a payment quote, please proceed to Pay the Civil Division.

 Protection Orders

Domestic Violence, Extreme Risk, Anti-Harassment, Sexual Assault, Stalking and Vulnerable Adult Protection Orders, commonly referred to as CPOs. For information regarding these Protection Order types, please refer to RCW 7.105 or the Protection Order Brochure in the Quick Links under Useful Resources.

For our office to attempt service, we need the completed Order, Order to Surrender and Prohibit Weapons (if applicable), Petition (if applicable), and the LE Confidential Info Form. This provides law enforcement with valuable information that will assist us in affecting service. The court of issuance will typically transmit the entire Order packet to us if the petitioner and/or respondent resides in the Kitsap County jurisdiction. We will file the Return of Service with the associated court for any Protection Order related services. There is no fee associated with the service of Protection Orders, per statute.

·The Kitsap County Sheriff's Office will only serve citizens who reside in unincorporated Kitsap County. If you are unsure of your jurisdiction, whether it is Kitsap County or a local police jurisdiction, enter the property address into the Law Enforcement Jurisdiction Map. If the respondent resides in a local police jurisdiction, please contact the local police department. *Please note: if your Protection Order includes minors as protected parties, the Kitsap County Sheriff's Office is not responsible to transfer custody of minors.

 Evictions

An eviction (Writ of Restitution) involves a tenant being ordered by the court to leave a residence. The court follows the Tenant-Landlord Act of the State of Washington. For more information about these laws and other eviction situations, please review the Applicable Common RCWs in the Quick Links.

Law enforcement will NOT get involved with an eviction until we receive a signed order from the judge accompanying a Writ of Restitution or Writ of Ejectment. We cannot provide legal advice or assist with the process to obtain the Writ. 

When providing your documents, please ensure the following are met, or it may be rejected for amendments prior to processing:

  • The Writ and Order contain the same property address.
  • The Writ and Order caption and cause number are the same.
  • The Writ and Order contain the same return period. Example: If you are not able to return the Writ within 20 days, the return on this Writ shall be automatically extended for a second 20-day period must be stated in both the Writ and the Order.
  • The Order must be signed by the judge/commissioner.
  • If a Sheriff's Indemnity Bond is required, it will need the principal and POA signature, accompanied by the POA document.
  • If the subject property is a mobile home that is not registered to the plaintiff, we will require a disposition letter from the plaintiff or attorney stating that it is acceptable to leave the mobile home in place.

Basic Steps:

  1. Obtain a court order to evict a tenant. If you are just beginning the process, contact an attorney. If attempting the process pro se (as your own attorney), please review the Useful Resources under the Quick Links.
  2. Complete a Writ of Restitution Tenant Info Sheet.
  3. Provide all items listed on the Writ of Restitution-Ejectment Intake. Payment must be made in advance.
  4. Tenant will be served with the Writ either by personal service or posting, as the statute allows.
  5. The Civil Deputies may conduct a status check to verify occupancy after three full judicial (excluding holidays and weekends) days have passed if their schedule allows. If the tenant has not vacated within the allotted three full judicial days, the Civil Deputy will communicate the findings with the contact person named on the Tenant Information Sheet to schedule a date and time for the physical eviction.
  • The landlord is responsible for providing the moving crew, locksmith, and all other needed items at the eviction.
  • The Kitsap County Sheriff's Office is not responsible for coordinating between a tenant and a landlord to obtain personal belongings that are left behind post-eviction. After the eviction has been executed, the Sheriff's Office involvement is complete. 

If there are still monies owed after executing the eviction, you will be billed for the remaining amount.

 Sheriff's Sales - Real Property

Sheriff's Sales are 'judicial foreclosures' (or executions) on real property to satisfy a money judgment. The documents are commonly titled Writ of Execution on Real Property or Order of Sale. The order to sell comes from the Superior Court Clerk. We are selling only the judgment debtor's interest in the real estate, and the property is subject to all existing liens and encumbrances. We have limited information about the sale property. We do not need to know any information other than the address, parcel, and legal description to conduct our sales. It is not possible for potential purchasers to view the interior of the structure prior to the sale.

The property sold may have a redemption period from eight months to one year. Redemption means that the owner may pay back the amount bid at the sale plus interest, taxes, etc., in order to 'redeem' the property and become the owner again. If you have legal questions about this procedure, you should contact your attorney for direction or read the Revised Code of Washington pertaining to redemption.

Sheriff's sale notices and notices regarding postponements or cancellations of sales are posted at the Kitsap County Courthouse at 614 Division St, Port Orchard WA 98366, the Kitsap County Sheriff's Office Central location at 3951 NW Randall Way, Silverdale, WA 98383, subject property and the Kitsap County Sheriff's Office Civil Division page of the website. Sheriff's notices of sale of real property are published in the Kitsap Sun newspaper on Fridays once per week for four consecutive weeks prior to the sale.

Sheriff's Sales of real property are held on Friday mornings at approximately 9 a.m. on the steps in front of the Kitsap County Courthouse at 614 Division St, Port Orchard, WA 98366.

If you bid at the sale, you must provide cash or a cashier's check made payable to the court clerk's office issuing the Writ of Execution or Order of Sale by 2:00pm, or the sale will go to the next highest bidder. No Exceptions.

A Writ of Execution on personal property is an order for the Sheriff to seize property belonging to the judgment debtor in a civil action. This action is also referred to as a Sheriff's Sale. The sales are generally held at 10:00am at the location where the property is being stored. The property may be viewed one (1) hour prior to the sale. If you are the winning bidder at the sale, you must provide the Sheriff with cash or a cashier's check made payable to the court clerk's office issuing the Writ of Execution, or the sale will go to the next highest bidder.

If the property is intangible, the sale will be held at the steps in front of the Kitsap County Courthouse at 614 Division St, Port Orchard, WA 98366

The Kitsap County Sheriff's Office will typically not receive an opening bid until two days prior to the sale.

If you are the successful bidder, we will provide you with a Bill of Sale. There is no right of redemption in personal property sales. The items are sold as-is and subject to any liens in place. You must provide cash or a cashier's check made payable to the court clerk's office issuing the Writ of Execution by 2 p.m., or the sale will go to the next highest bidder. No Exceptions.

A Writ of Habeas Corpus is a court order demanding action from the Sheriff's Office to locate and take custody of the named minor(s) in the order. An emergency hearing is scheduled after custody is obtained, and at that time, the judge will make a decision which parent/guardian the Sheriff's Office will release the minor(s) to. 

Courts use this powerful tool and extraordinary measure rarely. You should ask for a Writ in your custody situation only when other measures have failed.

A Writ of Habeas Corpus gives law enforcement the power to:

  • Break and enter to find minor(s).
  • Arrest authority for anyone who is obstructing the process.

 Writ of Execution Personal Property - Till Tap

A "till tap" is a method of debt collection where a sheriff or law enforcement officer seizes cash held in a business's cash register to satisfy a judgment debt. If the debtor is a business with a cash register, the sheriff can go to the address of the business and take enough money out of the cash register to pay the judgment debt and the sheriff's fee.
