2025 Letters of interest in providing indigent representation in Kitsap County
Good afternoon,
Kitsap County's Office of Public Defense is currently seeking letters of interest from attorneys who may be interested in contracting with the County next year to provide representation in any cases where the client is indigent and facing a deprivation of liberty or a deprivation of a liberty interest. Please find a copy of our 2024 compensation schedule attached for your reference as to the types of cases for which we currently contract. It is our expectation that this compensation schedule will change in 2025 for many of our contracts. We encourage all attorneys providing a letter of interest to address the subject of desired compensation in the body of your letter. In addition, please also include the identity of the attorney(s) that you anticipate will be performing the work of each contract that you seek along with a brief summary of their experience doing that type of work. Finally, for those of you who may be interested in felony or misdemeanor case contracts with the County, we are asking that you please indicate a preference in your letter as to one of two models of compensation schemes that the County is currently considering for next year. Please note that the figures used in the examples below are subject to change contingent upon both the input we receive from interested attorneys as well as from the County's budget analysts.
The first is what we are calling a monthly retainer model for felony and misdemeanor cases. In this compensation model, the County will compensate the attorney on a monthly basis contingent upon how many cases are assigned to the attorney per month. For felonies, we are currently considering offering monthly compensation as follows for 2025:
$12,500 per month to take up to 10 felony cases per month (with a minimum of no fewer than 9 cases).
$10,350 per month to take up to 8 felony cases per month (with a minimum of no fewer than 6 cases).
$6,500 per month to take up to 5 felony cases per month (with a minimum of no fewer than 4 cases).
In addition, in each of these monthly compensation scenarios, the attorney would be compensated for any trial or motions work on these cases at $660 per trial day/ $330 per trial ½ day.
For misdemeanors, the monthly compensation schedule that we are currently considering offering would work as follows:
$10,500 per month to take up to 20 misdemeanor cases per month (minimum of 16 cases per month).
$5, 250 per month to take up to 10 misdemeanor cases per month (minimum of 6 cases per month).
$2, 625 per month to take up to 5 misdemeanor cases per month (minimum of 3 cases per month).
For each of these monthly misdemeanor compensation schedules the attorney would also be compensated for any trial or motions work at the rate of $600 per trial day/ $300 per trial ½ day.
The second compensation model we are currently considering is a per case schedule involving a minimum compensation amount per case type with an additional hourly compensation component that would be triggered upon reaching a minimum number of hours in each case.
For felonies, we are currently considering offering this at $1,350 per felony case up to the first 15 hours. For every hour beyond 15, the attorney would be compensated at $110 per hour. There would be no additional trial or motions work compensation in this scenario as that work would fall under the hourly compensation figure.
For misdemeanors, we are currently considering offering this at $500 per misdemeanor low case up to the first 10 hours. For every hour beyond 10, the attorney would be compensated at $99 per hour. For misdemeanor high cases, the compensation currently being considered would be $675 per misdemeanor high case up to 10 hours with the attorney being compensated for every additional hour beyond 10 at $99 per hour. There would be no additional trial or motions work compensation in this scenario as that work would fall under the hourly compensation figure.
While we have not currently constructed similar models for the other types of cases that we currently contract for, any attorney interested in proposing a similar compensation model for the contract which you are seeking is encouraged to do so. As we look to update our compensation schemes in 2025, we invite fresh ideas from those who are interested in providing these valuable services.
