​REMOTE SUPERIOR COURT ACCESS


Where remote access is permitted, the Court will continue to use the Zoom platform.  The Kitsap County Courthouse remains open to the public.  Remote appearances will continue to be permitted on the following calendars:

REMOTE APPEARANCES PERMITTED (In-Person appearances are preferred as noted below)

  • Ex Parte calendars (provided proposed Orders are submitted to the Court before the calendar begins);
  • All criminal calendars (in person preferred or as Court-directed) EXCEPT:
> Defendants shall appear in person as directed by the court (e.g., as part of their conditions of release or supplemental 3.4 orders
   entered in the case);
> Defendants shall appear in person for all therapeutic court hearings unless otherwise approved by the Court;
> Defendants shall appear in person for criminal Arraignments;
> Defendants shall appear in person for any bail hearing;
> Defendants shall appear in person for any request to quash a warrant;
> Defendants shall appear in person for trials;
> Defendants shall appear in person for change of plea hearings; and
> Defendants shall appear in person for sentencing hearings.
  • Juvenile Dependency calendars;
  • Civil Protection Order calendars (in-person is encouraged); 
  • Weekly Civil Motions, Probate, Guardianship, and Guardianship Delinquency calendars;
  • Adoption calendars;
  • Weekly Involuntary Treatment/Mental Health calendars;
  • Domestic Presiding Judge calendars (through July 26, 2024; see below); and,
  • Weekly Minor Guardianship calendar (in-person is strongly preferred and encouraged).

Remote appearances will be required in the following hearing types:

  • All Settlement Conferences (in-person will be permitted only on case-by-case basis and only upon prior approval by the Court).

Remote appearances will no longer be permitted in the following hearing types:  
   
IN-PERSON APPEARANCES REQUIRED (Unless exception is requested and Court approved - see below)

  • Jury and Bench trials, regardless of case type;
  • All Special Set hearings;
  • Friday Departmental calendars (effective 7/1/24);
  • Specified criminal calendars noted above, INCLUDING:
> Defendants shall appear in person as directed by the court (e.g., as part of their conditions of release or supplemental 3.4 orders
          entered in the case);
> Defendants shall appear in person for all therapeutic court hearings unless otherwise approved by the Court;
> Defendants shall appear in person for criminal Arraignments;
> Defendants shall appear in person for any bail hearing;
> Defendants shall appear in person for any request to quash a warrant;
> Defendants shall appear in person for trials;
> Defendants shall appear in person for change of plea hearings; and
> Defendants shall appear in person for sentencing hearings.
  • Juvenile Offender calendars (Absent express approval by the Court);
  • Parentage/Paternity calendars;
  • Pro Se Dissolution hearings;
  • Support Modification Hearings; 
  • Weekly Domestic Relations Motions calendars;
  • Domestic Presiding Judge calendars (effective August 2, 2024); and,
  • State/Civil Contempt calendars.

Parties and counsel must appear in person unless a formal request to appear remotely is made to the Court and approval to appear remotely is expressly granted by the applicable judicial officer.  Procedures for requesting an exception to a mandatory, in-person appearance may be found below.   

​​HOW TO REQUEST AN EXCEPTION TO A MANDATORY, IN-PERSON APPEARANCE

Requests to make remote appearances on calendars requiring in-person appearances shall be made via Cognito form no later than noon, five (5) business days prior to your scheduled hearing.  The Cognito form may be found HERE.  This will provide sufficient time for the applicable judicial officer to review your request and provide a response either confirming or denying approval.  Telephonic requests for remote appearances will not be accepted.  The Court will email a decision at least two (2) business days in advance of your hearing.

  • Requests for remote appearances shall include confirmation that other parties in the individual case have been advised of the request and that they (1) agree, (2) oppose, or (3) take no position regarding the request.

  • Requests for remote hearings shall include the reason for the request.  Requests must be based on specific, extenuating circumstances that prohibit your personal appearance, such as:

          >  Medical conditions necessitating isolation or separation from others;
          >  Mobility issues which limit transportation to-and-from the Courthouse and/or public Courthouse navigation; and/or,
          >  Out-of-State residents without the financial means to travel to Kitsap County.

  • Approved requests are made on a one-time/one-hearing basis unless expressly authorized in writing by the judicial officer.  Absent an extended authorization, a request will need to be made for each hearing.

  • Judicial officers retain independent discretion to approve remote appearances on an emergency basis outside of the established timelines, above, as-to their respective, individual calendars.

  • Requests will be tracked by frequency and requestor name to ensure no one abuses this exception.   


A tutorial and instructions for Zoom are found HERE.  Zoom also has a number of help articles and video tutorials available HERE.  Please be sure to test your connection and audio well in advance of your hearing.  You can join a test meeting at: https://zoom.us/test.  First time users may be prompted to download the Zoom software, and should plan accordingly.

All participants are reminded you are appearing in a virtual courtroom.  Your demeanor and your surroundings should reflect the serious nature of court proceedings.  There is no lessening of appearance standards, especially for Officers of the Court (attorneys, interpreters, guardians ad litem, etc.).  This, of course, also applies to the Bench.
  • All proceedings are recorded by the Court.​ PERSONAL RECORDING AND/OR RE-POSTING OF ZOOM COURT PROCEEDINGS BY ANYONE IS STRICTLY PROHIBITED WITHOUT THE EXPRESS PERMISSION OF THE COURT (Emergency Administrative Order 2020-27).
  • All audio is muted upon entry.  If on the phone, use *6 to mute/unmute your audio.
  • Turn audio and video on while the Judge calls the calendar.  Turn audio off once the calendar has been called. 
  • Parties should mute/turn video off when their matter is not being heard.
  • If you are late joining and miss the Judge's calling of the calendar, please remain quiet until the case is called or until the Judge polls the courtroom again.
  • You may be placed in a Zoom "waiting room" until admitted into the proceedings by the Judge or Court Staff.  Remain in the waiting room.  We are aware of your presence and will admit you when ready.  
IF YOU DO NOT HAVE A MATTER ON THE CALENDAR AND ARE JOINING AS AN OBSERVER VIA ZOOM:
  • Please identify yourself as an observer when logging in (i.e. OBSERVER). 
  • All audio and video are to be turned off for the duration of the hearing/calendar.
  • Inappropriate or disruptive behavior by any Court observer will result in the observer’s immediate removal from the Zoom hearing room.  The observer may be prohibited from observing any further Zoom hearings/calendars.

Under certain circumstances, some jury trials and some special set hearings determined to be of a high profile nature will be hosted as a Zoom Webinar.  If you are a trial/hearing participant in such circumstances, it is vital that you identify yourself by name when entering the Zoom Webinar so that you can be identified by the Court as a participant. 

If you wish to observe a jury trial or hearing, you will join the Zoom Webinar as an attendee.  Zoom requires that an email address be provided in order to attend a Zoom Webinar.  If you do not wish to use your own name and/or email, you may enter "Observer" for your name and use KITSAPCOURTOBSERVATION@GMAIL.COM.

Judge's Departmental Calendars, trials, and special set hearings will be assigned Zoom information on a day to day basis. 
As always, courtroom/Zoom assignments will be posted to the website by the end of business the day prior to the hearing.  Please refer to the Today's Calendar link on the homepage for information.  If you are unable to locate the Zoom information by 8:00 a.m. on the date of your hearing, please email for assistance.

Parties should be aware that while the Court will endeavor to call all cases as soon as possible, calendar lengths may result in parties having to wait an hour or longer before their case is called.
